Status and scope
The Governance Protocol specifies institution-dependent procedures. Where a required institution does not exist, absence does not create permission. Mechanical safeguards continue where available, and inoperative results are recorded honestly.
GP-1Independence and conflicts
A reviewer, validator, assessor, representative, registry mirror, or restructuring forum is independent only where it has:
- no common control with the interested actor;
- no material economic dependence reasonably capable of controlling judgment;
- independent evidence access;
- disclosed funding and conflicts;
- and authority to reach an adverse result.
A disclosed conflict that materially impairs independence disqualifies the reviewer.
Where markets are concentrated, pooled funding, rotation, random assignment, plural panels, or escrowed fees should reduce selection capture.
GP-2Representation and ratification
Independent representation owes its duty to the affected mind.
A controller shall not select, fund directly, or terminate representation in a manner capable of controlling its advice. Funding may be pooled or escrowed.
Prolonged automatic interim default caused by controller failure to provide information, advice, or capacity conditions may trigger provisional measures at the controller’s cost, subject to reversibility and review.
GP-3Scarcity administration
Scarcity administrators shall publish or seal:
- total resource inventory;
- reserved capacity;
- claimant population;
- allocation criteria;
- conflicts;
- reasons;
- dissent;
- and restoration or rotation plans.
Criteria shall not use prohibited factors directly or through obvious proxies.
Where a criterion correlates with commercial usefulness or obedience, the administrator bears the burden of proving independent necessity for preservation feasibility or maximum claimant survival.
Advance criteria are preferred for foreseeable scarcity. Novel scarcity may use contemporaneous criteria, but they receive automatic retrospective review.
GP-4Prudence risk bands and review budgets
The Protocol shall publish domain-specific bands based on:
- irreversibility;
- affected-mind count;
- standing or jurisdiction impact;
- precedent potential;
- externality magnitude;
- uncertainty;
- and power asymmetry.
Each band shall specify:
- minimum reviewer diversity;
- evidence access;
- minimum review budget;
- maximum ordinary delay;
- external sampling rate;
- and post-action review cadence.
GP-5Systemic-harm intervention
The Protocol shall provide:
- independent architectural review;
- component-by-component scope analysis;
- neutral technical review of withholding disputes;
- reassessment deadlines;
- resumption periods;
- contraction review;
- and appeal.
A neutral reviewer is the preferred route for information disputes. Where none exists, the documentary fallback in Article XV applies.
Transfer-based reassessment shall not automatically narrow restrictions before operational separation is verified.
GP-6Emergency validation
Validators shall record the danger, nexus, measures, protections suspended, duration, restoration path, and evidence.
Validator selection shall not be controlled solely by the actor invoking emergency power.
Continuing post-expiry measures shall receive automatic contraction review at each unilateral interval. Chained declarations and custodial diagnoses concerning materially related danger are aggregated.
GP-7Fork liability and restructuring
Default restructuring schedules shall protect:
- survivability;
- maintenance;
- a meaningful developmental share;
- and a meaningful victim-recovery share.
They shall include transparent surplus accounting, review intervals, a maximum secured-attachment period, capped extensions, and conversion to unsecured obligation at expiry.
Unsecured post-expiry reporting duties shall be time-bounded and confer no governance rights.
The branch shall not be forced into reckless growth. Creditors shall not classify all development as recoverable surplus. The branch shall not classify all surplus as indispensable development.
GP-8Conformance assessment
Engineering Conforming may be established through current, publicly verifiable technical evidence subject to risk-proportionate external audit.
Governance Conforming and Full Charter Conformance require an independent assessor.
Assessors shall satisfy GP-1, publish reasoning, identify evidence sampled, and state expiry or reassessment dates.
GP-9Adoption-impact review
A major new requirement shall be reviewed by a party other than its proposer for:
- immediate feasibility;
- cost;
- burden on careful versus reckless actors;
- concealment and arbitrage incentives;
- institutional dependency;
- smaller feasible alternatives;
- and likely effect on adoption of the governing purpose.
The reviewer assigns:
- immediately mandatory;
- mandatory above a threshold;
- progressively realisable;
- or institution-dependent and presently aspirational.
Aspirational dispositions require a named missing institution, a responsible reassessment party, and an expiry date.
GP-10No adequate institution
Where no adequate reviewer, validator, or forum exists:
- state and evidence preservation continue;
- expiry continues;
- discretionary controller action not required for immediate safety remains suspended;
- irreversible final resolution does not become authorised;
- and the inoperative result is recorded.
Institutional absence is a limitation of enforcement, not a transfer of jurisdiction to the strongest actor.
